Terms and conditions
- Any order placed by the buyers with Techouse.lk Private Limited (the supplier) at any time whether on this form or not shall be subject to the terms and conditions of sales here in contained.
- This contract shall be between the supplier and the buyer as principal dealing with principal and shall be deemed to Conclusive on acceptance by the buyer
- The buyer shall not be entitled to very, amend, add or alter any of these conditions in any manner whatsoever
- The delivery will depend on availability of Stock. Part delivery shall be permitted and in the case of non-availability the supplier shall have the option to cancel the order. delay in delivery of goods shall not render the contract voidable on the part of the buyers the supplier will not be liable in damages or otherwise for delay in delivery where did the time of the essence of the contract or not the buyers have no right to withhold payment on this account nor shall reject the goods on this ground.
- The contract is subject to force majeure clause. The supplier shall not be liable for delay or non-delivery for reasons like difficulties in supply of stock or any other cost beyond the control of the supplier. non-compensation is payable to the buyer under such circumstances.
- If the buyer fails to take delivery, the shell reimburses the supplier to also storage and other expenses incurred in the respect of the goods delivered but not taken by the bias taken by the buyers.
- The supplier shall have a general lien on all goods of the buyers for the time being in the position of the supplies (including the goods already paid for but which delivery may not have been taken by the buyers) for the amount due to the supplier for the time due under this contract and also for any for but which delivery may not have been taken by the buyers) for the amount due to the supplies for the time due under the contract and also for any amount due to the supplier and any other contract with the buyers either alone or with another or others.
- No dispute regarding the quality of fitness of goods can be raised without notice to the supplier within three days of receipt of the goods. The supplier will not accept any return of goods unless agreed to invite written.
- No credit or set of for statutory levis already collected will be allowed on rejected good unless rejected goods are received by the supplier before the end of the next quarter.
- The supplier’s weight, measures and statements as to quantity and quality shall be presumed to be correct and that responsibility for the goods shall cease as soon as the goods are handed over to the buyers are the carriers as the case may be. in respect of any complaint whatsoever nature, that may be lodged in respect of the goods, the buyer agreed to first make payments in full before any of this action or settlements is negotiated.
- All payment for the goods must be made by the buyers to the supplier at the head office at Pelawatta or there Kiribathgoda branch office immediately on receipt of invoice. All payments made by checks are A subject to realization. The buyers shall pay interest at the rate of 22% per annum for payment made beyond the due date until the date of realization without prejudice to any contract of part of the contract for non-payment of accrued outstanding.
- All bank charges (including collection charges) and stamp duty on cheques, bills of exchange hundis shall be payable by the buyers. The supplier shall not be liable for any loss or theft of bank drafts, cheques etc. in transit
- If the buyers fail to take delivery of the goods on arrival of destination, the supply should have the right to treat such trailers as breach of contract in addition and without prejudice supplier’s other rights and remedies.
- If the buyer fails to pay for the goods and accordance with the terms and conditions of the contract, the supply shall be entitled to sell them by Public auction or private treaty after due notice to the buyers who shall not be entitled to claim any advantage from such action but shall be liable for all losses as may have been caused by the supplier.
- All contracts of the company are subject to the jurisdiction of the court of Sri Lanka-Colombo and all claims actions and petitions arising out of or in connections with this contract shall be interested in instituted in court at Colombo.
- It is acknowledged and confirm that Techouse.lK private limited shall have the rights to transfer or assign any of it right rising of the invoice/under this agreement including without limitation, the right to transfer and the receivables arising out of this invoice/agreement to any third-party, without having to secure any consent from you.
Warranty conditions
- Warranty has mentioned against each item (6M – 6 months, 1Y – 365 days, 2Y – 770 days, 3Y – 1095 days, blank – no warranty all conditions preview warranty)
- Techouse.lK private limited will not be responsible for any loss of data as a result of any defect/ repair/ virus infection/ replacement work done. It’s strongly recommended to back up your data all the time.
- Original invoice to be produced for warranty claims, serial numbers of items to be in track with each item warranty will be voided if warranty sticker/ serial number is damaged, erase or it is unidentifiable.
- A minimum period of 15 to 30 days will be required for any replacement repair for defective items.
- When a warranty item is brought for RMA, checking only the stated issue will be checked and repaired/ replaced, credit note raised etc. (depending on the situation) issues /defect etc… not stated in the initial complaint will not be attended to.
- The manufacturer or its appointed distributor reserves the right to replace/ repair or refund a product with a different model of item having similar feature and performance in the event of Model is unavailable for replacement during the warranty period. The distributor will replace the same with a higher more advance model after discussing an agreement by the customer to pay the difference.
- The warranty does not cover against… burn marks, pin damages, corrosion, scratch marks, damages against lightning, abnormal voltage, spilling of food or beverages, damages due to unauthorized tampering, natural disasters, defects caused by animals’/ insects etc.
- Warranty claim request for monitors made, based on their being “Dead Pixels” would be effective only if there are minimum of 7 dead pixels.
